Photos Made by Other People

Ownership of a creator’s photo stays with that creator, never with Let’s Home Decor. Many pictures here come from people who share them publicly on Pinterest or Instagram, and each one has the @handle of the account that shared it printed beneath it, linked to the post where it first appeared. The rest are AI-generated illustrations. Product shots, where a post has them, come from the stores selling those items.

Quick Image Removal

If you’re the owner of an image used on Let’s Home Decor and would like it removed, email [email protected] with the page link and a line showing the image is yours. I’ll review it and remove the material promptly. A formal legal notice isn’t required for this.

Formal DMCA Takedown Notices

Let’s Home Decor follows the DMCA process under 17 U.S.C. § 512. A valid written notice must contain:

  • The physical or electronic signature of the copyright owner or of a person authorized to act for them.
  • A description of the copyrighted work you believe has been infringed, or a representative list if several works are involved.
  • A description of the material on Let’s Home Decor you believe is infringing, with enough detail to find it, such as the page URL.
  • Your contact details: mailing address, telephone number and email address.
  • A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner of the exclusive right in question.

Send notices to [email protected]. When a valid notice arrives, I remove or disable access to the material.

Counter-Notification

If you believe material was taken down from Let’s Home Decor by mistake or misidentification, you may send a counter-notification with:

  • Your physical or electronic signature.
  • A description of the material that was removed and the URL where it appeared.
  • A statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification.
  • Your name, address and telephone number, plus a statement that you consent to the jurisdiction of the federal district court for your address and will accept service of process from the person who sent the original notice.

When a complete counter-notification arrives, I forward a copy to the person who filed the original notice. Unless that person reports within 10 to 14 business days that they have filed a court action, the material may be restored.

Repeat Infringers

Where appropriate, I will block or end access to Let’s Home Decor for anyone found to be a repeat infringer.

Misleading Claims

Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees.
